TERMS OF USE
Version 1.5 — effective 13 September 2026
1. Operator of the Service
"10 à l'ancienne" (the "Service") is operated on a non-professional basis by two individuals (the "Operator", "we", "us").
In accordance with Article 1-1 of French Law No. 2004-575 of 21 June 2004, which allows individuals operating an online service on a non-professional basis not to publish their identity, the Operator's personal identification details have been provided to the hosting provider, which holds them at the disposal of the judicial authority.
- Contact: contact@10alancienne.com
- Reports and legal matters: legal@10alancienne.com
- Personal data: privacy@10alancienne.com
- Hosting provider: Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA
- Data and photo hosting: Supabase, Inc., 970 Toa Payoh North #07-04, Singapore 318992 — servers located in the European Union
These addresses are our points of contact within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065. We respond in French and in English.
This information is available without creating an account.
2. Purpose, scope and acceptance
2.1 Purpose
These Terms of Use (the "Terms") govern your access to and use of the Service. They form a contract between you and the Operator.
The Service is a platform for football-shirt collectors, letting you display a collection, publish content, interact with other members and, depending on the features available, connect buyers and sellers.
2.2 Acceptance
Creating an account requires express acceptance of these Terms by means of an unticked box.
You must be able to read the Terms before accepting them. We record the version accepted, the date and time of acceptance and the account identifier, so that the contract can be evidenced.
The Terms remain available at any time, without an account.
2.3 Minimum age
The Service is for people aged sixteen or over. By creating an account you confirm that you are at least sixteen.
If we learn that an account was created by someone below that age, we will suspend it and delete the associated data in accordance with our privacy policy.
Setting a minimum age does not remove any obligations we may have towards minors under applicable law.
2.4 Personal use and professional selling
The Service is intended for personal use by collectors.
If you sell regularly and for profit, you may qualify as a trader under applicable law. You must then tell us, provide the required information, and comply with the obligations applicable to traders, including pre-contract information, statutory guarantees, cancellation rights and tax.
We may request the information and evidence reasonably necessary to determine whether a seller is acting as a private individual or as a trader.
2.5 Testing phase
The Service is currently open to a limited group of members. Some features may be incomplete, unstable or subject to change. We will tell you where this affects your use.
3. What the Service is, and what it is not
This clause defines the exact scope of our obligations. It governs everything else.
3.1 Features
Depending on the features available when you use it, the Service lets you:
- build, organise and display a football-shirt collection, as a public or private showroom;
- publish photographs, descriptions, stories and other content;
- follow other members and interact with their posts;
- message other members privately;
- build line-ups from your collection, see where it comes from geographically, and browse reference pages on clubs, stadiums, competitions and players;
- take part in the related game and community features, including collective assessment of authenticity;
- offer shirts for sale or respond to listings, where the Marketplace is available.
Available features may vary by country, account, Service version and product development.
3.2 Our role on the Marketplace
Unless expressly stated otherwise, the Operator is not a party to sale contracts between members.
We do not own the shirts listed and, where transactions are concluded directly between members:
- we are neither the seller nor the buyer;
- we do not set the price;
- we do not negotiate the sale;
- we do not guarantee delivery or handover;
- we do not hold the parties' money;
- we do not certify members' identity, solvency or good faith;
- we do not guarantee that shirts are genuine, their condition, or that they match their description.
We carry out no expert examination, authentication or certification of shirts.
3.3 Authenticity
Community authenticity indicators and votes are members' opinions, formed from the information available to them, including photographs, without any examination of the item.
They are not an expert assessment, a certification, a guarantee or a representation by the Operator that a shirt is genuine.
3.4 The nature of our obligations
We use reasonable care and skill to keep the Service available, secure and working, and to moderate content in accordance with the rules applicable to us.
This clause defines the subject matter of the contract. It is not an exclusion or restriction of liability, and does not operate as one where such exclusion or restriction is prohibited by law — including your rights under the Consumer Rights Act 2015, which cannot be excluded.
4. Your account
4.1 Creating one
You need a valid email address and an available username.
You agree to give accurate information, not to impersonate anyone, and to keep your information up to date.
4.2 Security
You must keep your credentials confidential and take reasonable steps to prevent unauthorised access. Tell us promptly about any unauthorised access you notice or suspect.
4.3 Personal account
An account is personal. It may not be sold, transferred or shared.
Creating or using multiple accounts to get around a suspension, restriction or moderation measure is prohibited.
5. Content and conduct rules
5.1 Prohibited content
You must not publish, transmit or make available through the Service, including by private message:
- content whose publication or distribution is unlawful;
- counterfeit content, or content infringing a third party's intellectual property rights;
- defamatory, abusive, threatening, hateful or violence-inciting content;
- sexual content where prohibited by law or by these Terms;
- content unlawfully infringing a third party's privacy, image rights or personal data;
- counterfeit shirts or unauthorised reproductions presented as genuine;
- listings or descriptions that are misleading, including as to condition, season, provenance, alterations or authenticity;
- photographs or other content for which you do not hold the necessary rights;
- photographs of identifiable people where publication infringes their rights;
- harassment, threats or impersonation;
- content intended to circumvent the Service's security or moderation measures;
- advertising or commercial solicitation unrelated to the Service or not authorised by us.
5.2 Expected conduct
Use the Service lawfully, fairly and with respect for other members.
For listings, describe the shirt accurately and disclose the material information you know: condition, provenance, alterations and, where relevant, any uncertainty about authenticity. A cautious description is worth more than a claim nobody can check.
6. Your Content
This is the most important clause in these Terms. It is written so that you can see exactly what you are granting.
6.1 Ownership
You keep all your intellectual property rights in the photographs, text and other content you publish (your "Content").
Publishing Content assigns nothing to us, and we are not asking you to assign anything.
6.2 The permission you grant us
Each time you publish Content, and for that Content, you grant the Operator a free, non-exclusive permission covering the following rights, each stated separately:
- reproduction: hosting, storing, backing up, copying and technically distributing the Content, on our servers and those of our hosting and delivery providers;
- communication to the public: displaying the Content within the Service to those entitled to see it under the visibility settings you have chosen;
- technical adaptation: resizing, cropping, compressing, converting formats and generating thumbnails, solely for display, storage and performance, without altering what is depicted.
This permission is delimited as follows:
- Scope: the Service's mobile application and website, and the derived formats needed to operate them.
- Purpose: solely to operate the Service as described in clause 3.1, and nothing else.
- Territory: worldwide, the Service being available online.
- Duration: for as long as the Content is published on the Service, plus thirty days after you delete it or your account, solely to clear technical backups, without prejudice to retention periods imposed by law.
6.3 What this permission does not allow
Unless you give separate, prior and specific agreement, the Operator may not:
- sell your Content, commercialise it or earn separate revenue from it;
- use it in advertising or promotional campaigns outside the Service;
- publish it on third-party social networks for promotional purposes;
- assign or license it to a third party for that third party's own purposes;
- use it to train an artificial intelligence model.
Our technical providers — hosting, storage, delivery — may process Content only so far as necessary to perform their services for us and on our instructions.
Any use beyond this requires your prior, separate and specific agreement, which we will ask for in each case and which you may refuse with no effect on your use of the Service.
6.4 Moral rights
Nothing in these Terms is a waiver of your moral rights, and we do not ask you to waive them. Under French law those rights cannot be waived at all.
6.5 Your representations and warranties
By publishing Content, you represent and warrant that:
- you took the photographs, or hold the rights needed to publish them;
- you obtained the prior, express and specific agreement of every identifiable person shown, for publication on the Service;
- where that person is a child, you hold the agreement of those with parental responsibility;
- the Content infringes nobody's rights;
- you do not present as genuine a shirt you know to be counterfeit or not genuine;
- publication goes no further than referring to goods lawfully placed on the market, as regards the trade marks, logos, club crests and sponsor badges appearing on the shirts.
You must promptly remove or correct Content where material information becomes inaccurate, or where a necessary permission ceases to exist — in particular if someone shown in a photograph withdraws their agreement.
You are responsible, under the general law, for loss caused to third parties or to us by your Content.
6.6 Deletion
You may delete your Content at any time.
Deletion ends the permission in clause 6.2 for future uses, subject to the thirty-day technical period and to legal retention obligations.
Some Content may remain where it has become part of an exchange with another member — a message sent, a sale conversation. We then keep it for that recipient, without reference to your account if it has been deleted.
7. How Content is used in the Service
This clause sets out, feature by feature, how the Service uses what you publish. It adds detail to clause 6 without widening it.
7.1 Showroom
Shirts you make public appear on your showroom, visible to other members and, depending on your settings, to visitors without an account. You control this shirt by shirt.
7.2 Feed and discovery
Your public posts may appear in the feed of members who follow you, in search results and in discovery pages. Ordering is explained in clause 10.5.
7.3 Map, atlas and reference data
From the descriptive information you enter — team, season, shirt type — the Service may associate reference data about a country, competition, club or stadium, in order to show where your collection comes from and to build reference pages.
This uses descriptive data, not your photographs. Reference pages may aggregate data from several collections in a form that does not identify any individual member, except where a public shirt is expressly shown as belonging to one.
7.4 Line-ups
Line-ups you create are linked to your account and displayed according to your visibility settings.
7.5 Wishlist
Shirts you add to your wishlist are not made public and are visible only to you.
A shirt's owner may be told how many people have added it, without being told who, unless you choose to contact them or to share your list.
7.6 Awards, tiers and rankings
The Service calculates awards, tiers and rankings from the data and Content associated with your collection. These change as your collection changes, and deleting a shirt updates the relevant calculations.
7.7 Private information
The purchase price you record for a shirt is never made public.
Serial numbers and identifying details you photograph are visible only to you, and to your buyer during a sale.
8. Private messaging
Private messages are for the participants in the conversation only.
We do not carry out any general or continuous reading of private conversations. A message may nonetheless be processed where it is reported, where processing is necessary for the security of the Service, or where the law requires it.
The rules in clause 5 also apply to private messaging.
9. Marketplace
9.1 How it works
The Marketplace lets members publish listings and make contact with a view to a sale.
Unless a specific feature states otherwise, the sale contract is made directly between buyer and seller, who alone carry its obligations and risks.
We currently take no commission on sales.
9.2 Private sellers and traders
Every listing shows whether the seller is acting as a trader or as a private individual.
A trader is responsible for complying with the obligations applicable to traders, including pre-contract information, statutory guarantees, cancellation rights and tax.
Where we allow traders to conclude distance contracts with consumers through the Service, we may collect and verify the information required by applicable law, including information identifying and registering the trader.
9.3 What buying from a private seller means
Where the seller acts as a private individual:
- the statutory guarantees that apply to purchases from a trader — including your rights under the Consumer Rights Act 2015 as to satisfactory quality, fitness for purpose and correspondence with description — do not apply;
- you have no cancellation right, since that applies to distance contracts with traders;
- the seller must still not misdescribe the goods and remains liable for misrepresentation under the general law;
- if you are in France, the sale remains subject to the Civil Code, including Articles 1641 and following on hidden defects.
If you live elsewhere, the rights that apply depend on your place of residence and on the applicable law.
9.4 If you sell
You must: be entitled to sell the shirt; describe it accurately; not offer counterfeit goods; disclose material defects and alterations you know about; perform the sale as agreed; and comply with your tax obligations and, where you act as a trader, with trader-specific obligations.
9.5 If you buy
You must give accurate information and honour the commitments you make to the seller.
Before any transaction, we recommend checking the photographs, description, condition, claimed authenticity and the handover and payment arrangements.
9.6 Payment and handover
As at the effective date of these Terms, and unless the Service states otherwise:
- we do not collect the sale price;
- we hold none of the parties' money;
- payment is made directly between buyer and seller;
- handover takes place in person, on the arrangements agreed between them.
It is for you to agree where and how the handover takes place and to take whatever precautions you think appropriate.
9.7 Future developments
The Service may offer secure payments, shipping, a commission on sales and features available by subscription.
These changes will substantially alter this clause and will be covered by specific terms, presented before those features are used and subject to your acceptance under clause 15. Nothing will be charged to you without your express, prior agreement.
9.8 Your tax obligations
Sums you receive from selling your shirts may be taxable and may attract social security contributions, depending on the nature and frequency of your activity.
If you are in France, guidance is available at impots.gouv.fr and urssaf.fr; if you are in the United Kingdom, from HMRC. This is repeated at each transaction, as required by Article 242 bis of the French General Tax Code.
10. Moderation, reporting and appeals
This clause meets Article 14 of Regulation (EU) 2022/2065.
10.1 Reporting content
Anyone, member or not, may report content they believe is unlawful or in breach of these Terms, using the tools in the Service or the legal contact address in clause 1.
A report should be sufficiently precise and substantiated: the exact location of the content, why it is thought unlawful, the reporter's contact details, and a statement of good faith as to the accuracy of the information given.
We acknowledge every report without delay.
Rights holders. A separate channel is available to owners of trade marks, copyright and related rights, and to people wishing to assert their image rights. Such a report should identify the right relied on and the content concerned.
10.2 Review
We handle reports diligently, objectively and without arbitrariness.
Review is carried out by a person. We use no automated decision-making to remove content.
We may use automated filters to flag wording suggesting counterfeit goods or prohibited content at the point of posting. These filters remove nothing automatically: they trigger a warning or a human review.
We tell the reporter what we decided and why.
10.3 Moderation measures
Depending on the nature, seriousness and repetition of the conduct, we may: ask for a change; remove or disable Content; limit its visibility; restrict certain features; suspend an account temporarily; or close it.
Any measure is notified to you, identifying the content concerned, the reason, the legal or contractual basis, and how to challenge it.
We apply these measures diligently, objectively and proportionately, having regard to the rights and interests involved, including freedom of expression.
10.4 Challenging a decision
You may challenge any moderation decision by writing to our legal contact address. The process is free and easy to use.
We will look at the matter again and give you a reasoned reply, in good time and without discrimination. Where practicable, the review is not carried out solely by the person who took the original decision.
10.5 How content is ordered
Content shown in the feed, in discovery and on the Marketplace is ordered by date of posting, recent activity on the content and, in the feed, the accounts you follow.
No payment currently determines ordering. If we introduce paid promotion, it will be labelled as such wherever it appears.
10.6 Repeat breaches
Repeated serious breaches, in particular counterfeiting, fraud or misleading listings, lead to progressive measures: warning, suspension, then closure.
10.7 Illegal content — United Kingdom
Where the Service is accessible in the United Kingdom, we implement the measures required of us under UK online safety law, including assessing the risk of illegal content, providing a reporting mechanism, taking down illegal content swiftly, and naming a person responsible for compliance.
11. Suspension and closure
11.1 By you
You may stop using the Service and delete your account at any time, for any reason and at no cost.
The consequences for your Content and data are set out in clause 6.6 and in our privacy policy.
11.2 By us
We may suspend or close an account for breach of these Terms, to meet a legal obligation, on a security risk, or for fraudulent behaviour, following clause 10.3 — notice, reasons, right to challenge.
Except where the seriousness or urgency of the situation requires immediate action, suspension is preceded by a warning and a reasonable period to put things right.
11.3 Data and Content after closure
You may ask for access to, and a copy of, the data concerning you, as provided by law and by our privacy policy.
Some data may be retained where necessary to comply with a legal obligation, to establish, exercise or defend legal claims, to prevent fraud, or to keep the Service secure. The relevant periods are set out in our privacy policy.
12. Availability, security and changes to the Service
12.1 Availability
We make reasonable efforts to keep the Service available and secure.
The Service may be temporarily unavailable, in particular for maintenance, updates, a security incident or a supplier failure. Where reasonably possible, we tell members about planned interruptions.
12.2 Changes
We may develop and change the Service's features. Where a change substantially affects your contractual rights or obligations, clause 15 applies.
12.3 Force majeure
Neither party is liable for failing to perform its obligations where that failure results from an event beyond its reasonable control, which could not reasonably have been foreseen when the contract was made and whose effects cannot be avoided by appropriate measures.
13. Backups
We keep backups as part of running the Service.
Backups are not a personal archiving service for your benefit. Keep your own copy of photographs and Content that matters to you.
14. Our intellectual property
14.1 Protected elements
The Service and its components — software, source code, architecture, interfaces, visual identity, name, logo, text, illustrations, reference data and databases — belong to the Operator or its licensors and are protected.
14.2 Databases
To the extent the legal requirements are met, the Operator asserts the rights available to the maker of a database, under Articles L.341-1 and following of the French Intellectual Property Code and the equivalent UK database right, in respect of the investment made in obtaining, verifying and presenting the contents of those databases.
14.3 Restrictions
Unless authorised in writing in advance, or permitted by law, you must not:
- extract or re-utilise a qualitatively or quantitatively substantial part of the contents of the Service's databases;
- repeatedly and systematically extract or re-utilise insubstantial parts where this goes beyond normal use of the Service or infringes the maker's rights;
- collect data from the Service by automated means, including scraping, crawling, bots or scripts;
- reproduce, adapt, translate or decompile the Service other than as the law allows;
- use the Service's distinctive signs in a way likely to cause confusion as to origin or affiliation;
- use the Service's data or content to design, train, feed or operate a competing service, where that use infringes our rights.
14.4 Licence to use the Service
For as long as you hold an account, we grant you a personal, non-exclusive, non-transferable right to use the Service for its intended purpose and in accordance with these Terms.
14.5 Third-party marks
Trade marks, logos, crests, badges and other signs appearing on shirts remain the property of their respective owners.
Their presence on the Service is a necessary reference to goods lawfully placed on the market and implies no affiliation, approval or sponsorship by those owners unless expressly stated.
15. Changes to these Terms
We may change these Terms, in particular because of changes to the Service, new features, legislative or regulatory changes, or security requirements.
Any significant change will be notified to you individually, electronically, at least thirty days before it takes effect, saying what is changing and what it means.
A substantial change — in particular one affecting clause 6, clause 9, price, or the subject matter of the Service — takes effect for you only after your express acceptance. Silence is not acceptance.
If you refuse a change, you may close your account at no cost and retrieve your data. The previous Terms continue to apply to you until then.
Every version is dated and archived. The version that applies to you is the one you validly accepted.
16. Personal data
How we process your personal data is described in our privacy policy, available without an account, which sets out the categories of data processed, the purposes, the legal bases, the recipients, the retention periods and your rights.
The Terms and the privacy policy are separate documents.
17. Complaints and disputes
17.1 Contact us first
If something goes wrong, contact us at the address in clause 1. We will reply within a reasonable time and try to find an amicable solution.
17.2 Disputes between members
A dispute about a sale between two members is a matter between the buyer and the seller. We are not a party to the sale contract and have neither the power to decide the dispute nor the means to investigate it.
Within the limits of the law and of data protection requirements, we may provide the information we are legally permitted to disclose where it is necessary to deal with a dispute.
17.3 Governing law
These Terms are governed by French law.
This choice does not deprive a consumer resident in another country of the protection of the mandatory provisions of the law of their country of habitual residence.
If you are a consumer in the United Kingdom, Part 2 of the Consumer Rights Act 2015 applies to these Terms regardless of that choice, and your statutory rights are unaffected by anything in them.
17.4 Courts
Nothing in these Terms deprives a consumer of the right to bring proceedings before a court available under the mandatory rules applicable to them. In particular, you keep the right to bring proceedings in the courts of the place where you live.
17.5 Alternative dispute resolution
Where a dispute falls within consumer ADR rules and the legal conditions are met, a consumer may use the competent approved mediator free of charge, after first making a complaint to us.
The Service is currently free of charge and the Operator has not appointed a consumer mediator. We undertake to appoint one before any paid offer and to publish its contact details in this article. Until then, send your complaint to legal@10alancienne.com: we will look for a solution with you.
18. General
18.1 Severability
If any provision of these Terms is held void, unenforceable or of no effect, the remaining provisions continue to apply so far as the law allows.
18.2 No waiver
Not exercising a right immediately does not waive the right to exercise it later.
18.3 Entire agreement
These Terms and the documents they expressly refer to constitute the agreement governing use of the Service, subject to the mandatory rights available to you.
18.4 Languages
These Terms are available in French and English.
For users resident in France, the French version prevails in the event of inconsistency. For users resident elsewhere, the applicable language and version are determined in accordance with the mandatory rules of the country concerned.
Version 1.5 — effective 13 September 2026
